Terms and Conditions

The Contract

When you book online, you will receive a booking summary form automatically by email. The Contract shall only start when the deposit has been received and you have received confirmation of this by email or post.


The Contract will be between the owners (Anna and Simon Morris) of Cobblestone Cottage and The Piggery (us/we) and the person making the booking.
The person making the booking must be at least 18 years of age at the time of booking the property. The person making the booking is responsible for ensuring that their party members comply with the terms and conditions as set out below.

Payment
Fees are as displayed on the website: www.cobblestonecottageholidays.co.uk.

A deposit of 25% of the booking fee is required to secure your booking for the stipulated dates.  The balance must be paid at least 6 weeks prior to the booking start date. If a booking is made within 6 weeks of the start date of your holiday then the payment must be made in full.

If the balance is not paid within a week of the balance being due, the customer will be deemed to have cancelled the holiday.

If there is an error in pricing we reserve the right to make changes to rental fees on the website.
Cancellation Policies
Please confirm any cancellations in writing, email or via the booking system. A cancellation will not be taken on the telephone.

Your inability (or the inability of any, some or all of your intended party) to travel to and stay at your holiday property for any reason (including but not limited to, illness, requirement or recommendation to self-isolate or quarantine, jury duty, incarceration, change in personal or work circumstances, family emergencies and travel delays) remains at your risk and does not give rise to a right to cancel or to receive a refund. We strongly advise that you take out holiday insurance to cover these eventualities and there are now several policies that will also cover COVID-19 related cancellations.

Cancellations 42 days (or more) prior to arrival date.

You will be refunded your deposit less £75 to cover costs. These costs include commission fees, marketing costs, accountants fees etc. Cancellations must be confirmed in writing (email is acceptable).

Cancellations that are made within 42 days of the arrival date, forfeit the full advance payment and reservation deposit. If it is possible to re-let the property then 80% of the final price of the new booking will be returned to you less £75 for administration costs (eg commission payments, accountants fees).  If we are unable to re-let the property you will be liable for the full cost of the holiday less £75 which will cover costs that we do not then need to pay eg laundry costs and cleaning. If these costs have already been incurred then you will be liable for these costs.

COVID-19 cancellation policy
National Lockdown – In the event of a national lockdown that coincides with the dates of your holiday and you are unable to travel and we are unable to open, then a full refund will be made or you have the opportunity to move the booking to an alternative date (subject to availability).

Regional/local lockdowns/tier restrictions – Should a booking have to be cancelled (by you or us) due to regional or local lockdowns or tier restrictions then we will offer you the choice of a full refund of monies paid or the opportunity to move the booking to an alternative date (subject to availability). Please note that this only applies to the address of the person making the booking on the booking form, not to other members of the party.

COVID-19 illness – should you or a member of your holiday party develop COVID-19 and be too unwell to travel home and need to remain in the cottage past the end of your stay then you will be liable for all costs incurred.

Cancellation by Us
If we have to cancel your booking for any reason, including a Force Majeure event, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, you will be refunded in full.
(a) acts of God, flood, drought, earthquake or other natural disaster;
(b) epidemic or pandemic;
(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
(d) nuclear, chemical or biological contamination or sonic boom;
(e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent;
(f) collapse of buildings, fire, explosion or accident;
(g) any labour or trade dispute, strikes, industrial action or lockouts;
(h) non-performance by suppliers or contractors; and
(i) interruption or failure of utility service, and the period of closure covers the period of your holiday booking.
Arrival and Departure

Guests are required to vacate the property by 10.00am on the day of departure and arrive after 3.00pm on the day of commencement, unless previously arranged.

Complaints
Please contact us if there are any problems with your accommodation. We aim to provide you with a property that is spotless and with everything in good working order when you arrive. We value your custom and want you to have great holiday.
If anything is found which does not meet expectations on, or soon after, arrival, we would wish to know as soon as possible so we can put matters right.
Right of Entry
The Owners are entitled to reasonable access to the property at all times during the occupancy if required. This includes maintaining the garden.
Care of the property, damages and breakages

You are responsible for the property for the duration of your holiday are are expected to keep the premises and all furniture, fittings and effects in or on the premises in the same state of repair and condition as at the start of the holiday.

You are legally required to compensate us for replacement, repair or extra cleaning costs. We know that accidents happen, however, and would not charge for the odd cup or glass breakage.  

Occupancy

The maximum number of guests in Cobblestone Cottage is 4 people, plus a baby in a cot. The maximum number of guests in The Piggery is 2.

Minimum stay

This property requires a 3 night minimum stay in the quieter periods and 7 nights minimum during peak periods. 

Inclusive fees

Rates include bed linen and towels, tea towels and kitchen basics. Please bring your own beach towels.  We do not permit towels or linens to be taken from the property.

Cobblestone Cottage – Heating is included. The heating can be controlled on individual thermostatic radiators and via a thermostat in the hall. Timings cannot be changed by guests. Please let us know if you require extra heating.
The stove is a multi-fuel stove. Initial fuel is supplied.  Please do not burn rubbish on the stove.

The Piggery – heating is included.  The heating can be controlled on individual radiators as well as by the thermostat in the sitting room.  Timings cannot be changed by guests so please let us know if you require extra heating.

Septic tank

Cobblestone Cottage and The Piggery are on a septic tank. It will clog up if anything other than loo roll is flushed away.  If it is found that sanitary towels and tampons have been flushed and clog up the septic system, you will be charged for damages.  Please dispose of these products in the bins provided

Internet

We have free WiFi but it is  a rural internet connection that may not be as fast as you are used to. If it fails we will do everything possible to get it reconnected but we do not guarantee availability. Please use the internet responsibly and ensure that illegal material is not viewed or downloaded using our WiFi connection.

Cot and high chair
A travel cot and high chair is available for your use (Cobblestone Cottage only).  Please let us know if you would like us to supply cot bedding (sheets and cot blankets).
Use of the property

Your stay does not give rise to any tenancy or the relationship of landlord and tenant between the parties.

The property is to be used as a holiday home only.

Maximum occupancy must not be exceeded.

These are no smoking properties.

Pets are not allowed in these properties.

Domestic utilities (heating, electricity, and water) are for normal, reasonable domestic use only.

You must not use the Cottages for any illegal, dangerous, offensive, noxious or noisy activities or behave in a way that may be a nuisance or annoyance to us, other guests or our neighbours.

For reasons of fire safety, candles and tea lights are prohibited.  Electric bikes are not allowed in or near the premises and the charging of electric vehicles and e-bike batteries is not allowed.
On departure you must leave the cottage in a clean and tidy condition.


We reserve the right to make modest changes in these terms and conditions subject to giving notice.

Severance
If a court finds part of this contract unenforceable the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Governing Law
These terms are governed by the laws of England and Wales. Each party agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising our of or in connection with the contract, its subject matter and its formation.
Third party rights
This contract is between you and us. No other person shall have any rights to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.
Notice
All notices served in accordance with this contract or otherwise should be served in writing on us at Lower Boskinning Farmhouse, Bone Valley, Heamoor, Penzance, Cornwall, TR20 8UN.

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us at the time of entering into the contract.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence.
We are not liable for business losses. The property is let only for domestic and private use and business use is not permitted. If you use the property for any commercial or business use it will be in breach of contract and we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
